Judge Mwiinde Siavwapa of the Lusaka High Court has brought a stop to the fraudulent prosecution and persecution of renowned business executive, Dr. Rajan Mahtani. This follows an application for judicial review that was made by Lawyers representing Dr. Mahtani, Simeza, Sangwa and Associates.
Dr Mahtani was arrested on trumped up charges of forging share certificates after the Mafia styled Ventriliglia family through the influence of former President Rupiah Banda managed to manipulate and hire some police officers to carry out their bidding. Following the controversial return of the Ventriglias from their native Italy through the influence of Rupiah Banda, the Italian mafias have constantly schemed to dribble Finsbury Investments, a company under the Mahtani Group of its 58% stake in the Ndola based Zambezi Portland Cement. The tricks have gotten dirty and it is reported that the depth of criminality that the Ventriglias and their connections are engaging in an effort to steal from Mahtani is reminiscent of the manuevers that they engaged during Rupiah Banda’s time as President.
But Dr Mahtani went to court to seek Judicial Review, arguing that his arrest was an abuse of the court process and that the matter had already been settled, among other arguments.
In his ruling today, Justice J.M. Siavwapa ordered the Director of Public Prosecutions to immediately stop the prosecution of Dr. Rajan Mahtani.
In granting leave for judicial review, Judge Siavwapa said:
‘In this case, the applicant has raised matters which, on face value, present impropriety on the part of the State and the veracity of the same out to be further investigated at the hearing of a substantive application for Judicial Review.’
This effectively means that Dr. Rajan Mahtani will not be subjected to any Criminal Court appearance, which were aimed at embarrassing and intimidating him. READ ATTACHED RULING HERE
